    Attorney Case Consultation

    Dr. Wilner provides telephone or in-person consultation with an attorney. Dr. Wilner will assist in determining mental health issues (e.g., competency to stand trial, criminal responsibility, mitigation). If she is unable to perform the requested services, she can provide recommendations for experts in the field.

     

    Dr. Wilner also provides in-court consultation. This includes assisting with development or providing advice to the attorney for the purposes of cross-examination of the opposing psychologist’s qualifications and testimony. She would solely work in the capacity of an advocate to the hiring attorney and would provide information related to weaknesses in the opposing expert’s methods and opinions.

     

    Unless hired to complete a psychological evaluation, Dr. Wilner will not provide professional opinion(s) about the defendant. To provide such opinion would be inappropriate and unethical in consultation.

    Record and transcript review

    Dr. Wilner provides record and transcript reviews. This consists of reviewing all available legal documentation (e.g., incident reports, defendant and witness statements, other experts reports), as well as the defendants medical, psychological, psychiatric, school, employment, and/or military records. This process takes considerable time, depending on the case and the information provided to Dr. Wilner. She will then provide a summary of findings and recommendations to the attorney. Given that Dr. Wilner has not assessed the defendant, her opinions would be limited. She could speak to the standards of care the defendant was provided (e.g., improper administration or interpretation of an assessment measure, or inadequate credentials of an expert called to testify); psychological issues that warrant further investigation (e.g., competency to confess, or competency to stand trial); and/or relevant research to the defendants case that may not have been discussed during the defendants initial trial or hearings (e.g., competence to stand trial [juvenile], competence of cognitively impaired defendant at arrest, or police photo line-up procedures).

    Forensic Evaluation and Courtroom Testimony

    Dr. Wilner provides courtroom testimony, based on her clinical findings pertinent to one or more issues within the case. This includes, and is not limited to, interview(s) with the defendant, interview(s) with the attorney, psychological testing, collateral contacts (interviews), and review of previous records (e.g., medical, school, psychological, psychiatric, performance evaluations, prior psychological evaluations). Just because an individual receives a forensic evaluation, does not mean Dr. Wilner will be subpoenaed to provide courtroom testimony. However, should she be asked to testify, she will provide her expertise, knowledge, and opinion regarding the defendant.

    Competency/Fitness to Stand Trial

    A legal concept when the Court or attorney requests an evaluation in regard to the defendant’s ability to understand the proceedings, the charges against them, as well as an ability to assist in their own defense.

    Criminal Responsibility (Insanity)

    A legal concept that is assessed after the defendant is determined to be competent. The psychologist assesses the defendant’s mental state at the time of the alleged offense.

    Mitigating Circumstances at Sentencing

    A legal concept that is reviewed after the verdict of guilt is rendered. The condition(s) that may be found in this type of evaluation are not used to excuse or justify the behavior, but are considered in order to enact a fair sentence or penalty.

    Diminished Capacity

    A legal concept that is reviewed after the verdict of guilt is rendered. The condition(s) that may be found in this type of evaluation are not used to excuse or justify the behavior, but are considered in order to enact a fair sentence or penalty.

    Sexually Violent Persons Evaluation

    New York State Law: Article 10. This evaluation occurs after a judge rules that the individual in question may be a danger to society, such that, they should be civilly committed for longer than their initial sentence.

     

    Pennsylvania Law: Title 42. This evaluation occurs after the individual has been convicted of a sexual offense, but prior to sentencing of said conviction.

    Violence Risk and Threat Assessment

    An evaluation that assesses historical, current, and future risk and protective factors regarding risk to harm of self or others. These evaluations may be for the workplace, for a firearm permit, for an individual who committed a sex offense (that is not included under Article 10), or domestic violence.

    Transgender Services

    Dr. Wilner worked with transgender or non-binary individuals in both correctional- and community-based settings. She provides evaluative services for transitioning individuals, as well as psychotherapy for transgender persons.

    Court Ordered Psychotherapy

    There are instances when a judge believes the defendant would benefit from psychotherapy as a part of the plea agreement or in the sentencing phase. Dr. Wilner utilizes empirically and evidenced based models of brief therapy. These models are designed to engage the individual and meet them where they are at with respect to their motivation to change.

    Public Safety Evaluations

    Dr. Wilner performs pre-employment evaluations for agencies, screening law enforcement officers, corrections officers, firefighters, or communications/ dispatch.

     

    Dr. Wilner performs fitness for duty evaluations for agencies. This type of evaluation is related to an officer experiencing psychological symptoms that are impacting their ability to perform the essential duties of their position.

    Other Consultation Services

    Presentations: Dr. Wilner presented in the community, as well as correctional facilities, on substance use and the brain, individuals who identify as transgender and are incarcerated, suicide risks in prison and ways to mitigate, and mindfulness-based practices.

     

    Editing: She provided editing services to students for dissertation, practical and internship applications, as well as professionals in the community for journal articles and books.

     

    Dr. Wilner, along with a colleague Dr. Megan E. Shaal, was the editor of a book, Principles of Health: Anxiety and Stress.

    Scholarship

    Dr. Wilner co-authored book chapters on ethics in gender research and LGBTQ+ marginalization in the workplace. Dr. Wilner completed several published book chapters and manuscripts that focus on gender and LGBTQ health.

     

    Recently, work with her colleagues was noted in the American Psychological Association "Science Spotlight" for an article published in Psychological Services regarding Quality Care for Incarcerated Transgender Clients. This article was also features on the APA webpage for LGBTQ+ Resources.

     

    An additional recent article Dr. Wilner assisted with was published in Death Studies. In collaboration with Dr. Jacob S. Sawyer and Dr. Melissa M. Ertl, the article focused on the Grief and Bereavement Beliefs Among Mental Health Professionals in the US and the General Public.

    Information on Fees and Services

    Forensic evaluations and interventions are not covered by insurance. If a clinical circumstance or situation arises during a forensic evaluation or intervention, it will be appropriately addressed on a case-by-case basis. Each evaluation and intervention, much like people in general, is unique. Therefore, Dr. Wilner's forensic fee schedule(s) will be discussed with attorneys and individuals at the time of first contact.

    Dr. Lindsey Wilner

    Psy.D.

    Dr. Lindsey Wilner is a Clinical Forensic Psychologist in East Lansing, Michigan. She is currently licensed in Wisconsin, New York, Pennsylvania, Virginia, and Michigan. Her experience consists of working with adolescents and adults in both the public and private sectors. Unique to the East Lansing area are her 7 years of academic training in Clinical Forensic Psychology, which involved rigorous law and psychology specialty coursework and applied professional training. Dr. Wilner’s academic training and history of working with a variety of individuals, provide her the ethical and clinical skills to competently practice the intersection of law and psychology.

     

    Dr. Wilner completed applied professional training with the federal bureau of prisons, local county jails, a psychiatric hospital, and state prisons. She worked for a period of time with the United States Navy, assisting with sexual assault prevention, long-term care facility in Pennsylvania, and taught masters level forensic psychology courses in an online program. Currently, she engages in forensic psychology practice in the community. She works as a Psychologist for Michigan Department of Corrections.     Dr. Wilner maintains affiliations with Division 18, 41, & 44 of the American Psychological Association (Psychologists in Public Service, American Psychology-Law Society, and Society for the Psychology of Sexual Orientation and Gender Diversity, respectively), International Association for Correctional and Forensic Psychology, Society for Police and Criminal Psychology, Michigan ATSA, and the national chapter of ATSA.

     

    Dr. Wilner was previously a board member of the YWCA Gettysburg and Adams County. She looks forward to continuing to build her volunteer experience in the East Lansing community!
